ARTICLE 1 : CONTRACT

The contract between L’Atelier Précieux and the customer is formed when the order is confirmed; This order confirmation summarizes the details of the order and serves as a contract between the Customer, L’Atelier Précieux and the website www.latelierprecieux.com. All products listed on the www.latelierprecieux.com website are available for delivery to all European Union countries;

ARTICLE 2 : ORDERS

ARTICLE 3: PRODUCT

All orders placed via the website are shipped subject to product availability; L’Atelier Précieux makes every effort to ensure that the products offered on the website are available when ordered; For technical reasons, the products chosen by the Customer may no longer be available from L’Atelier Précieux when the order is confirmed; In this case, the customer will be contacted by Customer Service to find a suitable solution; The essential characteristics of the articles are presented on our site in each of the article sheets under the heading “description”; The images used are not contractual, some differences may be present between the photographs and the real object; In fact, a photograph is an optical and technical process that can present variations and defects of aspect between reality and the rendering of the photograph; For size information, we advise customers to refer to the size guide on each product page, or to click on “Size Guide”

ARTICLE 4: PRICES

The prices indicated on the site are expressed by default in euros including all French taxes (TTC), on the basis of the French value added tax (VAT) at 20%, excluding shipping costs; L’Atelier Précieux reserves the right to change prices without notice; The products remain the property of L’Atelier Précieux until full payment has been received. The total amount due by the Customer is the amount indicated on the order confirmation. The total amount of the basket at step 1 is given as an indication, without taking into account the shipping costs that will be added once the shipping method has been selected. The total price will be indicated on the order when choosing the shipping method. The “Payment” step allows the customer to choose the payment method they wish to use. The amount indicated at this step is the total amount of the order, including shipping costs. Upon receipt of an order confirmation, an order invoice will be available in the “my account” area upon confirmation of the order by the Customer. This will include a summary of the products as well as the total price paid and debited.

ARTICLE 5: PAYMENT

All items purchased on www.latelierprecieux.com can be paid for by credit card; The debit is made at the time of order validation, after confirmation from the card-issuing bank; In accordance with the CNIL recommendation, they are secured by highly secure pages for entering payment data: card number, expiry date and visual cryptogram (PCI DSS standard); This platform encrypts and transmits payment data to the bank in complete confidentiality, making it inaccessible to third parties; If the bank refuses, the order will be automatically cancelled; At no time do the Customer’s bank details pass through L’Atelier Précieux’s computer system.

ARTICLE 6: DELIVERY AND SHIPPING

L’Atelier Précieux delivers the product(s) ordered to the delivery address indicated by the Customer at the “Delivery address” stage of the order. It is imperative for the Customer to verify the accuracy of this information. Any re-shipment due to an incorrect address will be charged to the customer. Delivery costs are calculated according to the delivery method chosen by the customer at the time of ordering. All orders are processed by L’Atelier Précieux within 2 to 3 working days. The customer receives an email when the order is dispatched with a link enabling him to track his order from dispatch to delivery, via the carrier’s website. Delivery times quoted are for guidance only. In metropolitan France, the delivery time may not exceed 15 days from receipt of the order confirmation e-mail. Delivery time is approximately 2 to 3 working days. However, L’Atelier Précieux cannot be held responsible for delays due to the carrier.

ARTICLE 7: RIGHT OF WITHDRAWAL

In accordance with the provisions of articles L.121-21, L.121-21-1, L.121-21-2 of the French Consumer Code, customers who are not satisfied with their order have a cooling-off period of 14 days after receipt of the goods to request a refund. The customer has no particular reason to exercise his right of withdrawal. In order to exercise his right of withdrawal, the customer can choose between.

If the Customer uses electronic means, L’Atelier Précieux will immediately send an acknowledgement of receipt of the withdrawal on a durable medium (e.g. by e-mail).
Products must be returned by post to the following address: L’Atelier Précieux, BP 93201, 75122 Paris Cedex 03. Return shipping costs are at the customer’s expense. If the Customer decides to return several items from the same order, it is imperative that all products are returned together. Products must be returned in their original packaging, in their original condition, new and unworn. If the returned product is damaged, it will be returned at the customer’s expense. The return of products will be at the customer’s expense. The customer will be reimbursed for the amount of the order for the returned product(s) no later than 14 days after exercising the right of withdrawal. However, initial delivery charges will not be refunded.

ARTICLE 8: RETURNED PRODUCTS

To return a product, you must first go to “my account – my returns” and make your request. Following this request, L’Atelier Précieux will send an e-mail to the Customer to inform him of the return procedure. If the return is the result of an error on the part of L’Atelier Précieux (reference, size, hidden defect, etc.), L’Atelier Précieux undertakes to refund the full amount of the product. Subject to the agreement of L’Atelier Précieux, the Customer will be reimbursed for the amount of the returned products. All returned products must be in undamaged, unworn condition and in their original packaging. If the product in question does not comply with these conditions, it will be returned to the customer at his expense.

ARTICLE 9: GUARANTEE

L’Atelier Précieux offers a 2-year commercial warranty on all jewelry. The jewel is guaranteed against all manufacturing defects for a period of 2 years from the date of purchase. This warranty is valid for normal use of the product. The following are excluded from the warranty: defects resulting from accidents, improper or abusive handling or use (such as shocks, marks from blows, crushing, exposure to corrosive agents) as well as the consequences of skin acidity, wear and normal aging of the jewel. On the other hand, any parts found to be defective due to a manufacturing defect will be repaired or replaced. In order for the customer to benefit from the warranty, it is necessary to have the purchase invoice for the jewelry. If the customer encounters a problem during the warranty period, he/she must contact customer service at contact@latelierprecieux.com to find out how to return the product and find an appropriate solution. When returning the product by the Customer, it is necessary to protect and carefully place the product(s) in their original packaging, which should be sent to L’Atelier Précieux, 7 Rue des Fontaines du Temple, 75003 Paris, along with the invoice. Beyond the warranty period, the customer can have his jewel repaired by our workshop with a prior estimate. If the customer accepts, we will repair the jewel and send it back to them as soon as possible. The repair will be carried out once the Customer’s payment has been validated.

ARTICLE 10 : RESPONSABILITY

L’Atelier Précieux cannot be held responsible for events that prevent the contract from being fulfilled and that are attributable to the customer, to a third party to the contract or to force majeure. Furthermore, the information contained in the site may contain technical inaccuracies or translation or typographical errors for which www.latelierprecieux.com cannot be held responsible. L’Atelier Précieux is not responsible for the use of other sites that customers may access via links on www.latelierprecieux.com. If a condition is found to be illegal or invalid, this will not invalidate the other conditions.

ARTICLE 11: APPLICABLE LAW

Sales concluded with L’Atelier Précieux via the website www.latelierprecieux.com are subject to French law. In the event of a dispute, an amicable solution will be sought before any legal action is taken. Failing this, all disputes arising out of or in connection with the validity, interpretation, performance, termination, consequences and consequences of the present contract shall be submitted to the competent court in accordance with the rules of jurisdiction of common law.

In addition, the graphics, texts and, more generally, everything that makes up the www.latelierprecieux.com website are the property of L’Atelier Précieux. All other graphics appearing on the jewelry and the website www.latelierprecieux.com are the property of L’Atelier Précieux and may not be reproduced. Photos and diagrams of products may not be reproduced. All names, logos, brands and titles used on this site are trademarks or registered trademarks of their owners. You are also reminded that all drawings, models and plans belong to L’Atelier Précieux, which has artistic property rights over all its products. The Customer acknowledges that any infringement of the trademark, designs or other graphics may be punished by criminal and/or civil penalties at the discretion of L’Atelier Précieux.

ARTICLE 14 : PERSONAL DATA

ARTICLE 15: CUSTOMS

Any order placed on the site and delivered outside mainland France may be subject to taxes and customs duties which are imposed when the parcel reaches its destination. Any customs duties and taxes associated with the delivery of an item are the responsibility of the Customer. L’Atelier Précieux is not obliged to check and inform its Customers of the customs duties and taxes applicable. To find out what they are, members should contact the relevant authorities in their own country. The language of these general terms and conditions of sale is French. This contract is governed by French law. In the event of a dispute with a Customer, the French courts will have exclusive jurisdiction.

PROVISIONS RELATING TO LEGAL GUARANTEES

  • Article L211-4 of the French Consumer Code: The seller is required to deliver goods in conformity with the contract and is liable for any lack of conformity at the time of delivery. He shall also be liable for any lack of conformity resulting from the packaging, the assembly instructions or the installation when the latter was his responsibility under the contract or was carried out under his responsibility.

  • Article L211-12 of the French Consumer Code: Any action resulting from a lack of conformity must be brought within two years of delivery of the goods;
  • Article L211-16 of the French Consumer Code: When the buyer asks the seller, during the period of the commercial guarantee granted to him at the time of the purchase or repair of a movable good, for a repair covered by the guarantee, any period of immobilisation, of at least seven days, is added to the duration of the guarantee which remained to run. This period runs from the date of the buyer’s request for service or from the date on which the goods in question are made available for repair, if the goods are made available after the request for service.
  • Article 1641 of the French Civil Code: The seller is liable for any hidden defects in the item sold which render it unfit for its intended use, or which impair that use to such an extent that the buyer would not have purchased it, or would only have paid a lower price for it, had he or she been aware of them.
  • Article 1648 paragraph 1 of the Civil Code: The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.
